Endereza Law, PLLC (“Endereza Law,” “Firm,” “we,” “us,” or “our”) respects your privacy and is committed to protecting the personal information that we collect and process. This Privacy Policy explains how we collect, use, disclose, and protect personal information obtained through https://www.enderezalaw.com, including webpages, forms, and other online services that link to this Privacy Policy (collectively, the “Site”).

1. Scope and Important Law Firm Disclosures

No Attorney-Client Relationship

Visiting this Site, submitting a form, sending an email, or otherwise contacting Endereza Law does not create an attorney-client relationship. An attorney-client relationship is
established only after the Firm has agreed to represent you and the required engagement documentation has been completed.

Do Not Send Confidential or Time-Sensitive Information

Please do not send confidential, privileged, highly sensitive, or time-sensitive information through a general website form or general Firm email address unless instructed to do so by an attorney or authorized Firm representative.

Information submitted before an attorney-client relationship has been established may not be treated as confidential or protected by the attorney-client privilege.

Conflicts Review

We may use information submitted through the Site to evaluate an inquiry and conduct a conflict-of-interest review. Providing information to us does not obligate Endereza Law to represent you and does not prevent the Firm from representing another person or entity unless the Firm has agreed otherwise.

Information Covered by an Attorney-Client Relationship

This Privacy Policy primarily addresses information collected through our public-facing Site. Information processed in connection with an established attorney-client relationship may also be governed by engagement agreements, applicable professional obligations, court orders, rules governing attorneys, and other legal requirements.

6. Sale, Sharing, and Targeted Advertising

Endereza Law does not sell personal information for monetary consideration. We do not knowingly sell sensitive personal information or biometric information.

7. Data Security

Endereza Law uses reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, loss, or destruction.

However, no website, electronic transmission, or information-storage system can be guaranteed to be completely secure. You should therefore avoid transmitting confidential or highly sensitive information through unsecured communication methods.

If the Firm provides you with an approved secure method for transmitting information or documents, please use that method.

If you believe information provided to Endereza Law may have been compromised, please contact us using the information below.

8. Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected and as appropriate to:

  • maintain business and professional records;
  • comply with legal, regulatory, contractual, and ethical obligations;
  • resolve disputes;
  • enforce agreements;
  • preserve legal rights; and
  • satisfy applicable limitation and record-retention periods.

Retention periods may vary depending on the nature of the information, our relationship with the individual, the purposes for which the information is used, and applicable professional and legal requirements.

When information is no longer reasonably necessary, we may delete, destroy, anonymize, or deidentify it, subject to applicable retention requirements and backup-system limitations.

9. Your Privacy Rights

Depending on where you reside and whether applicable privacy law applies to Endereza Law or the particular information involved, you may have rights concerning your personal information.

These may include the right to:

  • confirm whether we process your personal information;
  • access certain personal information;
  • correct inaccuracies;
  • request deletion;
  • obtain a portable copy of certain information;
  • opt out of certain sales of personal information;
  • opt out of certain targeted advertising;
  • opt out of certain types of profiling;
  • withdraw consent where processing is based on consent;
  • appeal certain decisions concerning a privacy request; and
  • exercise legally available privacy rights without unlawful discrimination.

The Texas Data Privacy and Security Act, for example, provides qualifying Texas consumers rights concerning access, correction, deletion, portability, and certain processing opt-outs.

Privacy rights are subject to applicable exceptions and limitations. In particular, Endereza Law may be unable to disclose or delete information where doing so would conflict with attorney-client privilege, professional confidentiality requirements, legal obligations, litigation holds, security requirements, or other applicable exemptions.

Email: connect@enderezalaw.com
Telephone: (210) 866-9936

Please describe the request and provide sufficient information for us to locate the relevant records and reasonably verify your identity.

We may request additional information reasonably necessary to verify your identity, residency, or authority to submit the request.

Authorized agents may submit requests where permitted by applicable law, subject to appropriate verification.

If applicable law provides a right to appeal our response to a privacy request, an appeal may be submitted to connect@enderezalaw.com with the subject line “Privacy Request Appeal.”

10. Marketing Communications

Endereza Law may send newsletters, legal updates, event invitations, and other professional communications as permitted by applicable law.

You may unsubscribe from marketing emails using the unsubscribe link included in the communication or by contacting us at connect@enderezalaw.com.

Even after you unsubscribe from marketing communications, we may continue sending nonmarketing communications relating to an existing client or business relationship, transactions, security matters, or legal notices.

11. SMS and Text Messaging

Text Message Communications

Endereza Law, PLLC may communicate with prospective clients, current clients, former clients, and other individuals by SMS or MMS text message when you provide a mobile telephone number to the Firm and consent to or otherwise request or permit communications by text message. Text messages may be sent using the Firm’s practice-management and client-communication platform, Clio, or another service provider used by the Firm. Clio supports SMS and MMS communications through a Firm-assigned toll-free number.

Types of Messages

Depending on your relationship with the Firm and the permissions you provide, text messages may include communications concerning consultations or inquiries, appointment confirmations and reminders, intake forms or documents, requests for information, billing or payment matters, matter-related updates, and other administrative or service-related communications. Clio Grow, for example, supports text notifications for appointments, intake forms, and documents.

Consent and Message Frequency

By providing your mobile telephone number and agreeing to receive text messages from Endereza Law, you authorize the Firm and its service providers to send text messages to that number for the purposes disclosed when your consent is obtained. Message frequency may vary based on your interactions with the Firm and the services you request. Consent to receive marketing text messages, if any are offered, is not a condition of obtaining legal services from the Firm.

Message and Data Rates

Message and data rates imposed by your wireless carrier may apply. Your wireless carrier is not responsible for delayed or undelivered messages.

Opting Out

You may withdraw consent to receive applicable text messages by following the opt-out instructions included in the message, including replying STOP when that option is provided. You may also contact the Firm at connect@enderezalaw.com regarding your communication preferences. Opting out of text messages does not prevent the Firm from communicating with you through other appropriate methods, such as telephone, email, secure client portal, or mail, where permitted or necessary.

Privacy and Security

Text messaging is not appropriate for highly confidential, privileged, sensitive, or time-sensitive information. Although text conversations stored within Clio are encrypted, Clio states that ordinary text messages are not encrypted while in transit. You should not send Social Security numbers, financial account information, passwords, highly sensitive personal information, or confidential documents by SMS unless specifically instructed by the Firm to do so. When appropriate, the Firm may direct you to communicate through a more secure method, such as its secure client portal.

Third Party Service Providers

Endereza Law uses third-party technology providers to facilitate certain electronic communications. Information transmitted through text messaging may therefore be processed by the Firm’s communications and technology service providers, including Clio, as necessary to provide those services and subject to applicable contractual, privacy, security, legal, and professional obligations. Clio’s services are provided by Themis Solutions Inc. under its own terms and privacy policy.

No Attorney-Client Relationship

Sending or receiving a text message does not, by itself, create an attorney-client relationship with Endereza Law. An attorney-client relationship is established only in accordance with the Firm’s engagement procedures.

12. Children’s Privacy

The Site is intended for business and professional audiences and is not directed to children under 13.

Endereza Law does not knowingly collect personal information through the Site from children under 13. If we learn that such information has been collected without appropriate authorization, we will take reasonable steps to delete it.

A parent or legal guardian who believes a child has submitted personal information through the Site may contact us using the information below.

13. Changes to This Privacy Policy

Endereza Law may update this Privacy Policy periodically to reflect changes in our practices, technology, legal requirements, or Site features.

When we update this Privacy Policy, we will revise the “Last Updated” date at the top of the Policy. Where required by applicable law, we will provide additional notice or obtain consent before materially different processing occurs.
